Late Filing Penalty and Interest Calculator
Each law has its own formula for delay: a fixed fee, a per-day charge with a cap, or interest for every month or part of a month. This calculator covers the five most common cases faced by Indian businesses and computes the exact amount from the due date and the actual filing or payment date.
Income-tax return – sections 234F and 234A
Filing after the due date attracts a fee of ₹1,000 if total income is up to ₹5 lakh and ₹5,000 otherwise. In addition, interest at 1% per month or part thereof is charged on any self-assessment tax still unpaid. Example: income ₹8.5 lakh, tax payable ₹25,000, return due 31 July filed on 16 October – fee ₹5,000 plus 234A interest for three months (August, September and part of October) = ₹750, total ₹5,750.
GST returns – late fee and interest
GSTR-3B and GSTR-1 carry a late fee of ₹25 CGST + ₹25 SGST per day (₹10 + ₹10 for nil returns), capped per return at ₹500 (nil), ₹2,000 (turnover up to ₹1.5 crore), ₹5,000 (up to ₹5 crore) or ₹10,000 (above ₹5 crore). Interest under section 50 is 18% per annum on the net tax paid through the cash ledger, counted per day. A 20-day delay in GSTR-3B with ₹50,000 cash tax costs ₹1,000 late fee plus ₹493 interest.
TDS – sections 234E and 201(1A)
A late TDS statement attracts ₹200 per day, limited to the TDS amount in the statement; delays beyond a year can also invite a penalty of ₹10,000 to ₹1 lakh under section 271H. Late deposit of deducted tax carries interest at 1.5% per month or part from the date of deduction to the date of payment (1% where tax was not deducted at all). Because "part of a month" counts as a full month, a deduction on 30 June paid on 8 July is charged for two months.
ROC forms
AOC-4 and MGT-7 cost ₹100 per day of delay with no ceiling. LLP Forms 8 and 11 are ₹10 per day for small LLPs (₹20 for others) for the first 300 days and ₹50/₹100 thereafter. DIR-3 KYC has a flat ₹5,000 late fee, and other event-based forms are charged as a multiple (2× to 12×) of the normal fee depending on the slab.
Use the result to decide whether to file immediately or wait for an amnesty, and to compute the challan amount before filing – GST and TDS portals will not accept the return until the fee is paid.
